Dear Clayton Community:
Clayton City Council candidate Ed Miller published this statement in the Pioneer about the flyer being circulated: "Not only do I deny every one of their allegations, they are all easily refuted by public sources." Since Ed bases his campaign on "Trust," let's see how TrustED stacks up against those annoying public sources. See TrustED's cumulative truth score below:
FIRST ALLEGATION: ED MILLER SUPPORTS OUTSOURCING POLICE SERVICES
-Refer to the September 16, 2022, Pioneer, page 9, Miller stated, "the city should be taking a long-range look at sharing cost and services with other cities or agencies, much as Danville and Orinda do with law enforcement. Both cities contract with the county Sheriff's Department for their police services". Sounds like outsourcing police services to me.

SECOND ALLEGATION: ED MILLER VOTES FOR HIGH DENSITY APARTMENTS IN HISTORIC DOWNTOWN
-Refer to page 15 of the May 25, 2021 Planning Commission Minutes. The votes to approve the Olivia extension was as follows: Altwal, Chippero and Miller - Yes, Gavida - No, and Denslow - Abstain. It took 3 votes to pass and he was one of the three.

THIRD ALLEGATION: ED MILLER HAS GIVEN 3 REASONS WHY HE VOTED FOR THE OLIVIA EXTENSION
1) Refer to page 13 of the May 25, 2021 Plannings Commission Minutes. Miller stated, "the developer had made a showing of good cause..."
2) Refer to the September 16, 2022, Pioneer, page 9, Miller stated,"I did, (voted for the extension) because there was no legal way not to".
3) Ed posted on social media, September 5, 2022 when asked why he voted for the extension, " I did so on the advice of the city manager and city attorney....'
Sounds like 3 reasons to me. It is much easier to keep your story straight t if you tell the truth the first time.

FOURTH ALLEGATION: EITHER ED MILLER DOES NOT UNDERSTAND CALIFORNIA OPEN MEETING LAWS OR HE CHOOSES TO IGNORE THEM
-If Ed Miller (as stated above) based his decision to approve the Olivia extension solely on advice given to him by the city manager or city attorney prior to the May 25, 2021 Public Hearing (This correspondence was mentioned at the public hearing by a commissioner and the city attorney), then it is a violation of Government Code Section 54950, Brown Act, which basically states that public business must be conducted in public and the decision makers must keep an open mind until they hear testimony from the staff, the applicant and the public in an open meeting. We can't get a straight answer from TrustEd, so we have to give him the benefit of doubt and conclude he did not intentionally violate the law--TrustEd just did not know the law.

AND FINALLY: ED MILLER VERBALLY ATTACKS THE SPOUSE OF COUNCILMEMBER ON SOCIAL MEDIA
-FIRST, family members of a Councilmember should be Off-Limits even for TrustED.
-SECOND, If you want to hear what TrustEd said, watch the June 29, 2021 City Council meeting under Public Comments and see the exchange of comments between TrustED and Councilmember Jeff Wan.
-THIRD, there is an email obtained under the Freedom of Information Act between Ed Miller and Peter Cloven prior to the June 29, 2021 council meeting plotting TrustEd's disrespectful comments about Councilmember Wan, and it was read by TrustED at this meeting. I guess this was before Cloven's "kindness" directive took affect. Perhaps TrustEd should have issued an apology instead.

Final Truth Score: Public sources - 5, TrustED - 0, Looks like TrustEd failed the truth test. Those annoying public sources always get it the way.
Moral of the story: If you are going to deny allegations and dismiss them as misinformation, use public sources as your defense, and tell people it can be easily refuted by these public sources, then it would be a good idea to check them out first.
